New York Officials Rise Up Against Democrats' Pro-Illegal Immigrant Laws
Several NY county clerks refuse to comply to state laws giving illegal aliens more rights
Following the recent passing of a pro-illegal immigrant bill, pushed through by New York's Democrat-controlled state government, several NY officials have risen up and vowed to refuse to comply with the new laws, according to reports.
The new laws allow illegal immigrants to obtain driver's licenses in New York state.
The Democrat-pushed legislation was signed into NY state law by Democratic Governor Andrew Cuomo on Monday, hours after it passed the state Senate.
The measure allows the 725,000 illegal aliens living in New York to be eligible for driver’s licenses when they reach the legal age.
State officials, including a Democrat state Senator, are now warning the law will effectively allow illegal aliens to vote in American elections, however.
“Theoretically, they could have the ability to vote,” Democrat state Sen. Luis Sepúlvedahe (D) said.
Some New York county clerks are refusing to comply with the law, however, which takes effect in about 180 days, the Blaze reports.
Rensselaer County Clerk Frank Merola told WRGB-TV on June 5th that he won’t issue driver’s licenses illegal immigrants that come into his office.
“I’m going to refuse to issue a driver's license to anyone who comes into my office that can't prove to us they're here legally,” Merola said.
"Federal law states we're not allowed to aid someone who comes into our office who is here illegally."
Rennselaer County Executive Steve McLaughlin told WRGB-TV that the law is wrong and just a political move to give illegals the opportunity to vote, and he plans to support any county clerks who refuse licenses for illegal immigrants, no matter what the law says.
In Erie County, Clerk Michael "Mickey" Kearns said he not only refuses to comply with the law, but he also plans to challenge the law in court.
Kearns drafted a letter to the Erie County Attorney's Office seeking official legal representation, the Buffalo News reports.

"As I understand it, this Act requires that, as an agent of the Department of Motor Vehicles, I will be compelled to give driver's licenses to illegal immigrants," he wrote.
"I will not be granting driver's licenses to illegal immigrants."
"I anticipate being sued in either event," Kearns wrote.
"As a result, I intend to file a declaratory action in the United States District Court challenging the law as applied to the Erie County Clerk, and I request your representation in this lawsuit and in supporting the Constitution and the laws of the United States."
If the judge orders the clerks to comply with the law, “We'll jump off that bridge when we come to it," he said.
