Federal prosecutors have asked a judge to drop the criminal case against the two jail guards who were charged over their roles in Jeffrey Epstein's death.

Tova Noel and Michael Thomas were guarding convicted pedophile Epstein on the night he died in his jail cell while awaiting trial on child sex trafficking charges.

The pair failed to check on Epstein and admitted to falsifying records.

The guards were facing possible jail time after they admitted to “willfully and knowingly” lying on forms stating that they’d made the required rounds checking on inmates the night of Epstein’s 2019 death.

Noel and Thomas were allegedly sat just five yards from Epstein’s cell but shopped online, slept, and took breaks instead of checking his cell every 30 minutes as required.

However, in a sudden turn-around, federal prosecutors asked a Manhattan judge on Thursday to dismiss charges against Noel and Thomas.

Instead, prosecutors agreed to allow Noel and Thomas to complete 100 hours of community service on the condition they cooperate with federal investigators’ probe into Epstein’s death.

The move comes just one day after Epstein's pimp Ghislaine Maxwell was convicted in a New York court of multiple charges for her role in the decease pedophile's child sex trafficking operation.

Maxwell is now facing up to 65 years in prison.

The day after Maxwell's conviction, prosecutors sent a legal notice (pdf) informing the judge they wish to abandon criminal proceedings against Manhattan jail guards Tova Noel and Michael Thomas.

Thomas’s lawyer, Montell Figgins, said his client was happy with the dismissal and looked forward to putting the matter behind him, while Noel’s lawyers did not immediately respond to requests for comment, reported Reuters.

Epstein had connections with many powerful and wealthy people, including Bill Clinton and Britain's Prince Andrew.

He was found dead in his jail cell at the Manhattan Correctional Center (MCC) on August 10, 2019, while he was being held on charges that he operated a sex trafficking ring.

New York City’s medical examiner ruled his death a suicide.

Maxwell was found guilty on five sex-trafficking charges, including that she had helped recruit and groom children for Epstein and his powerful friends to sexually abuse for at least a decade. 

Maxwell is expected to appeal her conviction.
